AHPA Hemp-CBD Status Report

To help the herbal products industry understand the evolving regulatory landscape for hemp and hemp-derived cannabidiol (CBD) products, AHPA has updated its free Hemp-CBD Status Report to include recent actions taken by the Food and Drug Administration (FDA) and the U.S. Department of Agriculture (USDA).

April 2020 revision covers:

  • Additional information on the USDA Interim Final Rule issued in October 2019
  • USDA updates since then, including two portions of the interim final rule for which they will be implementing enforcement discretion
  • What growers should be aware of for the 2020 growing season
  • FDA developments since the report was last issued – warning letters continue to be issued, the consumer update issued in October 2019,
  • March 2020 FDA report to Congress on CBD regulation, and consideration of legislative options

The revised Status Report: Marketing of hemp and cannabidiol (CBD) products in the United States following passage of the 2018 Farm Bill also covers:

  • FDA actions on hemp-derived CBD in dietary supplements and foods, including recent public statements, hearings, enforcement policy and safety review.
  • FDA’s position on hemp-CBD in cosmetics as stated on its website Q&A.
  • USDA’s listening session to gather information and feedback from stakeholders as they develop regulations.
  • Details on USDA's Hemp Production Program to be administered under the Agricultural Marketing Service (AMS) have been posted on the USDA website.
  • USDA has issued a notice to trade regarding the importation of hemp seed.
  • USDA issued legal opinions regarding the implementation of some hemp provisions in the 2018 Farm Bill.
